Modifying a villa or townhouse in a Nakheel community in Dubai starts with a master developer No Objection Certificate (NOC), applied for through Nakheel Online Services or Nakheel MyCommunity. Only then can your consultant apply for the statutory building permit. Which authority issues that permit depends on where the property is. Palm Jumeirah projects go to Trakhees. For several inland communities, sources disagree, so the authority should be confirmed with Nakheel at NOC stage.

This guide covers the jurisdiction question, how Nakheel classifies works, fees and deposits, geotechnical rules on reclaimed land, the approval route, and site access and working hours. General information about Nakheel's communities is on nakheel.com.

The jurisdiction question to settle first

Nakheel Community Management acts as master developer across its communities and issues the design NOC in all of them. The statutory building permit that follows is issued by a government authority, and this is where owners and contractors most often go wrong.

Palm Jumeirah and PCFC land

Villas on Palm Jumeirah, including Signature Villas, Garden Homes and custom frond plots, and properties on PCFC maritime land are under Trakhees, the building control authority of the Ports, Customs and Free Zone Corporation. After the Nakheel NOC, the consultant submits the technical package to Trakhees for a modification permit. After construction, Trakhees inspects the works and issues a Code of Conformity (COC), which Nakheel requires before it releases the security deposit. Our guide to Trakhees fit out approval covers that process in detail.

Inland Nakheel communities

For Jumeirah Islands, Jumeirah Park, Al Furjan, Jumeirah Village Circle, Jumeirah Village Triangle and Discovery Gardens, published sources do not agree. Some list Dubai Municipality as the permitting authority, with submission through the Dubai Building Permit System on dm.gov.ae. Others list Trakhees. Treat the question as open for your plot and confirm the authority with Nakheel when you apply for the NOC. The answer decides which portal your consultant uses, which engineers can stamp the drawings, and which completion certificate closes the project.

If the answer is Dubai Municipality, our guide to Dubai Municipality fit out approval explains the next stage.

How Nakheel classifies modifications

Nakheel groups alterations into three categories, each with its own documentation and fee level. Knowing the category early helps set a realistic programme.

Category A, minor internal works

  • Kitchen and bathroom refits that keep the primary drainage stacks in place.
  • Built-in joinery, wardrobes and wall panelling.
  • New floor finishes at the existing slab level.
  • Repainting, lighting redesign and smart home systems.

Typical documents are architectural layouts, material specifications, the contractor's trade licence and Contractor's All Risk (CAR) insurance.

Category B, major internal and structural works

  • Removing load-bearing or dividing walls to open up living areas.
  • Cutting slabs for double-height voids or skylights.
  • Remodelling a staircase, adding a mezzanine or making major electrical changes.

These need structural stability calculations stamped by an approved engineering consultant, plus an MEP load assessment.

Category C, external works and extensions

  • Building a pool, sunken lounge, outdoor kitchen or jacuzzi.
  • Adding a first-floor room or enclosing a terrace.
  • Installing pergolas, raising boundary walls or changing entrance gates.

These add boundary setback checks, a geotechnical soil report, and structural or piling calculations where foundations are involved.

Fees and security deposits

Three types of charge apply: the Nakheel review fee, a refundable security deposit, and the government permit fee charged by Trakhees or Dubai Municipality. Each scales with the category of work. Because amounts are revised from time to time, this guide does not quote them. The current Nakheel schedule is shown on its service portals, and the authority fees on the Trakhees or Dubai Municipality portal.

Clear service charges first

Before you can submit, the owner must clear all outstanding service charges. The online system checks the account and rejects applications while arrears remain.

How the deposit works

Nakheel holds the deposit while works are under way to protect shared roads, kerbs, street lighting and drainage. Once the project passes its final inspection and the completion certificate or COC is submitted, the deposit is refunded, commonly within 14 to 21 working days.

Geotechnical rules on reclaimed land

On Palm Jumeirah and other reclaimed or waterfront plots, shallow foundations are usually not enough for heavy structural additions. A geotechnical investigation is commonly required before an excavation permit, and the engineering package typically covers the following.

  1. Boreholes and groundwater. Soil testing to confirm compaction, sand density and the depth of the water table.
  2. Piling and dewatering. Engineered piles for pools and extensions to limit settlement, and dewatering arrangements approved by the relevant authority.
  3. Shoreline integrity. Confirmation that pool excavation does not load or undermine the beachfront revetment or neighbouring retaining walls.

Pools near the beach also call for waterproof concrete mixes suited to the marine environment. Build these engineering steps into the programme from the start, because they are rarely quick.

The approval route in five stages

  1. Account clearance and appointment. Settle service charges and issue a formal appointment letter to the design and fit out contractor.
  2. Nakheel design review. Upload drawings, renders and specifications and pay the review fee. Review commonly takes one to three weeks depending on scope, ending in the Nakheel design NOC.
  3. Government permit. Submit to Trakhees for Palm Jumeirah, or to the authority Nakheel confirms for inland communities. Review commonly takes 5 to 10 working days.
  4. Contractor access. The contractor submits its trade licence, insurance and deposits to obtain gate passes.
  5. Works, inspection and deposit release. After the works, a joint inspection is carried out and the deposit is released once the completion certificate or COC is presented.

Overall, pre-construction approvals commonly take four to six weeks for a complete submission. Incomplete drawing packs are the most common reason for that window stretching.

Site access and working hours

Documents for contractor entry

  1. The Nakheel design NOC.
  2. The approved Trakhees or Dubai Municipality permit.
  3. The contractor's DED trade licence with the fit out contracting activity.
  4. CAR and third-party liability insurance at the coverage Nakheel requires.
  5. Emirates ID copies for site engineers, foremen and workers.

Working hours and noise rules

  • Construction is commonly permitted from 8:00 AM to 6:00 PM, Monday to Saturday.
  • Heavy demolition, jackhammering and noisy cutting are commonly restricted between 1:00 PM and 3:00 PM in occupied villa clusters.
  • No construction on Sundays or public holidays.
  • Noisy work outside permitted hours can lead to access suspension and deductions from the deposit.

Confirm the hours stated in your NOC, as individual communities can set their own rules. If you are comparing processes across developers, see our Emaar alteration permit guide.

Frequently asked questions

How long does a Nakheel NOC take?

Commonly one to three weeks for Nakheel's review, then 5 to 10 working days for the government permit, giving four to six weeks overall for a complete submission.

Can I apply to Dubai Municipality directly for a Palm Jumeirah villa?

No. Palm Jumeirah permits and completion certificates are processed by Trakhees after the Nakheel NOC.

Which authority covers Jumeirah Islands, Jumeirah Park, JVC, JVT and Al Furjan?

Sources disagree between Dubai Municipality and Trakhees. Confirm with Nakheel at NOC stage before your consultant prepares the government submission.

What documents does a Nakheel NOC need?

Typically the title deed, the owner's passport or Emirates ID, a contractor appointment letter, the contractor's trade licence and CAR insurance, proof of service charge clearance, and architectural, structural and MEP drawings appropriate to the category of work.

Can I add a first-floor extension in Jumeirah Park or Al Furjan?

Possibly, subject to Nakheel's planning review. The extension must stay within the community's floor area and plot coverage limits and setbacks, and structural calculations must show that the existing structure can carry the added load.

When is the deposit refunded?

After a successful final inspection and the issue of the completion certificate or Trakhees COC, commonly within 14 to 21 working days.

Master developer policies, authority fees and portals are updated from time to time by Nakheel, Trakhees and Dubai Municipality. Confirm current requirements on the official portals before you submit.
